The Ottawa-area owner of an asbestos removal company has received a sentence of 45 days in jail for asbestos related offences. Despite the nominal nature of the jail time, the sentence sends an important message about the serious nature of non-compliance with asbestos safety regulations.
The Details
The man was sentenced in Ontario Provincial Offences court and the nature of his charges make it easy to see while the judge felt jail time was necessary.
- He had received not one but two previous court orders under the Environmental Protection Act requiring him to remove asbestos waste from one of his properties.
- In November 2015, he was convicted for his failure to comply with those orders.
The current owner took over an asbestos removal company in 2007 and continued operating the business. After removing asbestos from a job, he would have the material bagged and then take it personally to be stored in trailers that he parked on one of his properties, away from his main offices.
After the company developed financial problems, the trailers were abandoned and a complaint was subsequently filed. The two previous orders to comply were issued over a period of 22 months and despite taking responsibility for the problem, the man did not clean up the two trailers.
The business is no longer in operation, according to sources at the Ministry of the Environment.
